Yahoo!オークションにはガイドラインというものがある。ガイドラインには、利用者が「同意する」必要があると書かれているのだが、じつは無視してもいっこうにかまわない。Yahoo!オークションの事務局であるYahoo! JAPAN自身が、僕とのメールのやりとりのなかで、ガイドラインは無視してもかまわないと認めたのだ。Yahoo! Auction has its guideline. The guideline says that the participants shall follow this guideline. But in fact, every participant can neglect it. Yahoo! Japan admits that the participants can break the guideline in the e-mail I received from the secretariat of Yahoo! Auction, i.e. Yahoo! JAPAN.

事のいきさつはこうである。僕はYahoo!オークションに、11Mbpsの無線LANアクセスポイントを出品した。すると翌日、北海道標津郡中標津町東5条南5丁目1番地にある有限会社マルイ電気の代表取締役・井沢敏行が落札した。Things happened as follows. I uploaded the information of wireless LAN access point I wanted to sell on Yahoo! Auction. The following day a company called Marui Denki made a successful bid.

最近あたらしいことを学んだ。Yahoo!オークションは闇市だったのだ。なぜ闇市かというと、ルール違反の参加者がはびこる無法地帯だからだ。 Recently I learned a new thing. Yahoo! Auction is a black market. That's because there are many participants who never follow the rules.

落札後のメールで、マルイ電気は「取引の決済方法についてですが、弊社は代金引換のみで行っております」というメールを送りつけてきた。僕が代金引換では取引できないとはっきり表示して出品していたにもかかわらず、である。In the e-mail Marui Denki sent to me after the bid, the company said, "Our company pays only by cash on delivery" although I clearly declared that I refuse any bid by cach on delivery.

ガイドラインには「相手方に対し一方的な成約や履行を迫るような行為はYahoo!オークションガイドラインの趣旨に反します」とあるので、有限会社マルイ電気のやっていることは、ガイドラインに違反している。Marui Denki apparently acted against the guideline of Yahoo! Auction.

僕としては当然、マルイ電気の落札を取り消した。そのためYahoo!オークションのしくみとして、自動的に「非常に悪い」という評価が２つつくことになった。こちらには落ち度がないのに、市場で悪い評価を受けるという理不尽なことになった。Naturally I canceled the bid of Marui Denki. As a result, I got two "very bad" evaluations from the system of Yahoo! Auction. I did nothing wrong. Why did I have to be evaluated "very bad"?

僕はマルイ電気にも同じように「非常に悪い」という評価をつけた。出品者の条件を無視して落札し、一方的に取引条件をおしつけるのはルール違反だとコメントをつけた。すると、マルイ電気は「代引き拒否で他人を悪評価するのはルール違反です」というコメントとともにこちらを「非常に悪い」と評価し返してきたのだ。I evaluated Marui Denki as very bad as well and commented that it is against the rules that you unilaterally tried to make a bid by cash on delivery. Then Marui Denki evaluated me as "very bad", saying that it is against the rules that I evaluated them because it's me that refused cash on delivery.

ここで僕ははじめて気づいたのだが、このマルイ電気という業者は、すでに70件以上の「悪い」「非常に悪い」評価をうけていた。文字どおり札付きの悪徳業者だったのだ。I finally noticed that this company called Marui Denki has already more than 70 "very bad" evaluations on Yahoo! Auction. This company is a wicked trader.

事前にこのような悪徳業者が落札しないようにするには、どうすればいいだろうか。オークションに参加している全ユーザーの評価履歴を調べあげて、悪い評価のついているユーザーを一人ひとり、拒否リストに加えるしかない。じっさいにこんなことをするのは不可能である。How can we refuse the successful bid of such wicked traders in advance? The only way to do so is to research all the participants of Yahoo! Auction and add those who had many bad evaluations in the past to our refusal list. It's impossible to do this kind of time consuming task for ordinary users.

だとすれば、悪い評価が多いユーザーは、強制的に市場から追い出すしかない。市場が有効に機能するために、市場がルールにしたがって運営されているように監督するのは、Yahoo! JAPANの責任ではないのか。しかもマルイ電気は70回以上、同じルール違反をくりかえしている。Then the wicked traders have to be excluded from the market. Is it the responsibility of Yahoo! JAPAN to supervise the market to make it operated according to the rules? Marui Denki repeats the same illegal act more than 70 times!

そこで僕は、こんなユーザーは市場から排除してほしいと、Yahoo!オークションの事務局に３度要望した。それに対するYahoo! JAPANの回答には、あきれてものも言えなかった。「当事者間でお話し合いいただけますようお願い申し上げます」の一点張りなのだ。利用料を徴収しておきながら、ルール違反したユーザを野放しにしておくYahoo! JAPANに、市場を運営する資格などない。I sent an e-mail three times to Yahoo! JAPAN. The e-mails asked them to exclude this kind of users from the market. I was startled by every response. All that Yahoo! JAPAN said was, "Please discuss between you". Yahoo! JAPAN, which collects entry fee from users while they throw away the responsibility of managing the market appropriately, is not qualified at all to manage the auction market.

ただまあ、孫正義が経営する会社が、まともなことをやっていると期待する方が間違いだったとも言える。いずれにせよYahoo!オークションは、悪意のユーザーがはびこる闇市であることを、読者のみなさんは知っておいた方がいい。Now I think that it's my own fault to expect that Masayoshi Son's company does the right thing.
